False and Misleading Advertising / Deceptive Marketplace Practices
1. Supply of Misdescribed Goods: This merchant advertised a genuine OEM factory-branded component (Bosch FL WM Pump, Part Number: 00146083) on their storefront. Upon delivery, they supplied a visually distinct, generic third-party substitute (labeled Kebs 121/115 1186546) without my consent.
2. Refusal of Consumer Rights & Cessation of Contact: After contacting the merchant via their website form, they responded by claiming the substitute part was "correct" and questioned my right to a return. When I explicitly clarified that the part received did not match the advertised brand or colour, the merchant completely ceased all communication and refused to provide a return address or refund.
3. Successful Bank Chargeback: Due to the merchant's refusal to supply a lawful refund for misdescribed items, I escalated the issue to my financial institution. My bank has investigated the matter and has officially ruled in my favour, forcing a full refund via a successful chargeback.
4. Invalid Public Data: The customer support email displayed publicly on their storefront sales email address is completely invalid and bounces back, forcing all initial communication to strictly take place through their web form.
5. Regulatory Actions: In addition to the successful bank chargeback, formal consumer fraud complaints have been successfully lodged against this entity with Consumer Affairs Victoria (CAV) and the ACCC.
