We lost everything to a house fire

We lost everything to a house fire. David Letichever of Magen Homes (1000698258 Ontario Ltd and 2415875 Ontario Ltd) bid on the rebuild of our house. We asked him if he had Tarion, he said yes. His contract stated he provided Tarion. After months of delay, and us ultimately asking him for proof he could in fact provide Tarion as per his contract, we spoke to Tarion and the HCRA directly and discovered not only does he NOT have Tarion, he is also NOT licensed to build a house at all. He is an illegal builder according to the HCRA and under investigation. He demanded money constantly and although we initially paid him over $260k, we stopped because we became suspicious with all the sketchy excuses he gave for needing more money. He's now refusing to pay back any of the money despite not being legally able to build a house. We have filed complaints with Tarion, the HCRA and police. We have also retained a lawyer. David has delayed our house construction now for 8 months with all of this and the rebuild of our home, after losing everything, is in serious jeopardy. His partner also got involved. Faysal Ahmed of CM Designers & Engineers Ltd (also operating as The Construction Master Inc. and CM Inspection & Testing Inc.) together with David on the phone and in emails, proposed we sign a contract with Faysal whereby he would provide the Tarion and David of Megan Homes would complete the foundation under the original contract. Tarion told us a house must be fully constructed by only one builder to qualify and for Faysal of CM Designers & Engineers Ltd to put David's construction under his Tarion registration would be fraud. Faysal was not named in the construction contract and never brought up prior to this to us, however they told us they arranged all this when David signed the contract with us. Faysal knew David could not build a house legally. Apparently we were the only ones that didn't know. Faysal and David both told us they have worked together for years and do this all the time. Faysal continued, along with David, to try to convince us to sign a contract with him although no contract was actually produced by Faysal and our house build was never enrolled with Tarion despite the insistance of both Faysal and David it would be. With David of Megan Homes fraudulently entering a contract to build a home with a Tarion warranty, but knowingly not being licensed or eligible to do so, we saw huge red flags with Faysal of CM Designers & Engineers Ltd. Faysal claimed David gave him $28k for the Tarion however we never saw proof of this and Faysal could not register our home build without us signing a contract with him which Tarion requires to enroll the home. I would not want this happening to anyone else. Faysal of CM Designers & Engineers Ltd will have their own review. David lied to us from the start, constantly stalled the build and provided unbelievable excuses one after the other, and what little he did do, there were constant errors and inadequate work on this behalf. He then claimed that he spent the entire $260k which is obviously untrue, and another contractor we consulted said isn't possible. Not even close. David Letichever cannot be trusted. He lied to us constantly and when we said show us proof, he would say "absolutely" and never provide it. Do not trust David Letichever or Magen Homes.

David Letichever also operates as Blue Horizon Builders and All GTA Home Reno. The pictures he shows on Bark of his "work" under the Blue Horizon Builder name is NOT his work for customers. It is his own home that has been financed by money he has taken fraudulently from people like us.
