Breaches of Your Own Terms
1. Jurisdiction & Service Restrictions
Your Terms state that OWNR does not market to or serve clients in jurisdictions where your services are not permitted. I am based in the UK, and the transactions in question were processed through your platform. This is inconsistent with your stated policies and therefore constitutes a breach of your own Terms.
2. Prohibited / Unlawful Use
Your Terms also state that clients must not use OWNR’s services for unlawful or prohibited purposes. In this case, your systems were used to process gambling-related transactions which circumvented my bank’s gambling block protections. This amounts to misuse of your services under your own rules.
3. Accuracy and Transparency of Merchant Data
Your Terms make clear that OWNR expects accuracy and transparency in its services. However, the gambling merchants involved deliberately masked or misrepresented their transaction data to bypass consumer protections. By allowing these transactions to be processed, OWNR failed in its responsibility to maintain transparent and lawful use of its platform.
4. Duty to Prevent Misuse / Compliance Obligations
As a regulated entity, OWNR has a duty to monitor and prevent misuse of its services, including fraud or prohibited transactions. Allowing repeated disguised gambling payments through your infrastructure, despite clear risk indicators, represents a failure of these obligations.
My Request
On the basis of the above breaches, I require:
1. A full refund of all gambling-related transactions processed through OWNR on my accounts.
2. Written confirmation that my details have been permanently blocked to prevent any further gambling-related transactions via OWNR.
If I do not receive a satisfactory resolution, I will have no choice but to escalate this matter to your acquiring partners, the FCA, and the Financial Ombudsman Service for further regulatory review.
On that basis 100% refund of all transactions most definitely applies.
