Snorecenter does not stand behind their warranties

I ordered 2 of them and it took 3 weeks to get them in USA. The product is too large for my tongue and I could not get it to create the vacuum required to stay in place. It clearly states that if you have such trouble to contact them for a refund. I did and they stated that I cannot returned them because they had been opened.
Question is how does one know if it works for oneself if opening the product makes it not elegible for a refund.
They are crooks !!!!
