Breach Of Contract, Unprofessional Bullying Behaviour
Breach Of Contract, Unprofessional Bullying Behaviour
- Updated - (Scroll down to the bottom for the latest development)
When It became increasingly difficult to contact SW19, emails were seldom returned, members of staff mysteriously 'unavailable' when we called, out of frustration we decided to terminate the contract, giving an explanation and due notice. SW19 agreed, but suggested to our shock, a course of action that was a breach of the contract.
Initially, we weren't aware of this but soon realized that both sides have to give an 8 weeks notice in order to terminate. Which we were happy to do, however, SW19 decided to violate several clauses, sending a series of angry and disturbing emails attempting to force us to do the same.
2) They decided to stop all 'work' on our account.
This was further exacerbated when we asked for details of their Property Redress Scheme. We quickly received an angry email from L*** B****** (Company Director) stating he had instructed his staff with 'immediate effect', to stop all work on our account.
Puzzling right?
Below are more issues encountered with SW19
a) Tenants Information
We found out the contact details of the tenants on the tenancy agreement supplied by SW19 were 'questionable', most of the email addresses and numbers listed in the contract didn't work. SW19 claim they do stringent background checks? But had never informed us of any changes to the tenants, their details or tenancy agreement. When we requested the correct/updated contact details of the people living in our property, they refused to provide it.
So we finally get a hold of the tenant, only to discover they also had issues with SW19. At one point they were given the wrong key code and left stranded outside. Emergency emails were seldom responded to in time, often they had to wait weeks for a response.
b) Rental Deductions
Quite by accident, we discovered a significant sum of money had been taken from the rental received without our prior knowledge. SW19 'claimed' It was for works that had been carried out. However, we'd already paid for these (as confirmed by emails to SW19 at the time). It took us having to provide bank statements dating almost 2 years back before they returned the funds.
c) Collecting Management Fees
They collected their Management Fees in January but refused to provide any Management services.
d) Condescending Emails
We attempted to schedule a date and time for a site visit and was informed by SW19's 'AA', 'via email', that she wasn't prepared to wait around all day for us.
The other emails received, 'really' have to be seen to be believed.
We received mocking emails sent by the Directors. In these, we're referred to as 'Stupid / Unintelligent' and mocked for filling a police report when SW19 refused us access to the tenant's details.
e) Debts:
It would also appear SW19 did not inform the tenants that they had to pay their Heating & Hot Water Bills, despite directions from us (almost 2 years ago), stating this was the tenant's responsibility. The tenants then went without paying this bill for almost 2 years. Once we found out, investigated and supplied an accurate (bill) breakdown, SW19 refused to send this bill to them.
Their reasons;
a) They claimed they weren't aware of the bill. (This is false, as we'd informed them of It almost 20 months ago).
b) They claimed the HHW was part of the communal system. (Again this is false, It isn't and has never been). If they had bothered to call the block management company, they would have found out that every apartment is responsible for theirs. It was clear nobody at SW19 checked these facts.
c) AA then stopped responding to our emails when we tried to investigate further.
d) Another Director, despite being copied in on most emails, stated she didn't know anything about the situation.
f) Missing Documents
We're still waiting on some paperwork they promised to send.
ALL STATEMENTS made here can be corroborated/proven by email correspondence sent/received from SW19. If interested feel free to reach out for more detailed information.
Complaints about this company have been sent to the PRS (Property Redress Scheme) and Trading Standards. I shall be updating this particular section with more information in due course. Stay tuned.
-Update-
When PRS contacted SW19, shortly after, I received a call from Director 'HV', who stated PRS had been in contact, he then apologised for what had occurred and agreed to return the money owed for January (management fees).
I accepted his apology, and the money has since been refunded back to us.
Thank you.
