Waterproof peaked caps

I ordered two peaked caps for half price in the sale and they are perfect. I wear them whilst walking my dogs - they stay out even in the wind. Very pleased with my purchase.

The hat I ordered is well made

The hat I ordered is well made, is the correct colour as shown on the website, and fits perfectly. It looks great on, and certainly looks much more expensive than it was. The package arrived within 5 days. All in all very happy with my purchase.

An awful customer service experience

UPDATE: My Bank have reviewed my case and evidence and challenged Winterhats 4 u for the money back on a “Charge Back” (actually Fascinators 4u – same people running all of these). They have refunded and successfully brought the case to a conclusion getting the money back, this demonstrates the strength of my case. I am still about £5 out of pocket (sending the product back) which makes my blood boil only because of the type of the person and their attitude. Avoid avoid avoid, plenty others will sell what they sell.

Original Review...
I would be careful about purchasing from this company and the sister/parent company Fascinators 4 Weddings (from whom the money was taken by) - same people. I wish I’d have checked Trust Pilot before purchasing and hope my review aids someone who has or might have no alternative but to make a purchase here as it’s the only place to get their product - check it right away and if anything is wrong, get on it immediately - I’ve seen reviews indicating similar difficulty when when inside their returns policy period.

Purchased a hat as a Christmas present for my brother, well in advance of Christmas for a change (5th December). Upon receiving the hat on Boxing Day, my brother informed me that he hat didn’t fit, and so I got onto them there at Winter Hats 4U on the 28th December.

Immediately blunt and defensive without willingness to help, he claimed my 14 days had past for a refund and was not prepared to exchange the hat for a replacement (one that fits). I measured the hat and it was in fact 1cm larger than labelled, which can easily be the difference between the hat fitting securely and hanging low or blowing off in the wind.

After a few uneasy email responses from WH4U, I was told if it was too big, that would be grounds for a refund because he could send it back to the manufacturer as faulty goods. I sent the hat back (at cost to me) along with a video of me measuring the hat carefully and accurately - there can be no question upon seeing my measurement.

Two weeks had past when I contacted WH4U twice for updates. At this point I told he was only about 2/3 of the way through his Christmas returns (encouraging), and then was met with further strong resistance, claiming they have measured the hat 3 times and it was as expected - no evidence of this unlike myself with a video. Every response of mine was met with denial of the inaccurate size irrespective of my unquestionable video evidence. I had responses telling me that the manufacturer had been making superior quality hats since 1903 and many other deflective arguments, as well as other irrelevant arguments for this situation - like the size of his own head and comparing the size as smaller than his head so must be ok.

He kept offering to chase the director for a good will gesture whilst he now has has my money and the product - also telling me I can have the hat back for a further £6 delivery to cover their costs. He is the director (all one person), this came across strange.

There hasn’t been an ounce of basic customer service or willingness to resolve the situation. I was happy in the initial contact for a replacement hat to be sent as long as they took the time to measure and ensure the new one was accurate in size - after all, the Christmas present was still very much wanted. I happen to have the same hat for myself (purchased elsewhere online) but in a different colour and same size, which fits perfectly, as did the one I originally saw in a shop previous to my own purchase.

I now want my money back (having spend 20% of the value of the hat) sending it back, I will be out of pocket even if I do get that back. I’ve taken advice from Citizens Advice, but Director keeps declaring this a Consumer Contracts Regulations 2014 issue - focussing on the fact that I notified them outside of their own self imposed 14 day returns policy (no leniency for Christmas returns like most retailers), whereas this hat isn’t as described - i.e. larger than the labelled size. It is therefore a Consumer Rights issue covered by the Act of 2015 under the implied terms that all goods must be as described. I offered to take this to an ADR scheme, but he’s not willing to going down that path, forcing me to take legal action.

Interesting the bad reviews here on TP, he is urging customers to retract their poor reviews citing the damage it can do to a small business. We come on here to share our honest experience for the benefit of - I don’t often do these like most, it comes out of sheer frustration and unreasonable behaviour. My advice would be to work on the customer service efforts and be reasonable both in communication and action, rather than forcing customers down a legal path like it doesn’t matter to them - my guess is that they take the risk that not many people would spend out more than cost the product to take it further.

Hi

All our customer reviews after yours are 5-star. So, people can draw their own conclusions on who is in the right in this case.

We completely disagree with most things claimed and point out that we are rated as 'Excellent' by our customers across all sales channels.

This customer returned an item too late for a refund under UK law - simple as that. We agreed to check the sizing and found the size to be correct as you would expect from a premium hat maker that has been making premium headwear for over 100 years (Failsworth Hats).

The customer then tried to threaten us with legal action in an attempt to get their money back. The experience has been odd from start to finish - they sent us a video of them 'measuring' the hat! But, rest assured, we keep our prices low for our customers by not accepting such vexatious claims.

Again, we are rated 'Excellent' by our customers. Look at all the reviews after this one - all 5 stars.
