unfair imbalance power relationship : you pay he does not
I signed a contract with Berkeley International in France, through their local representative. The fees involved were significant.
The experience turned out to be very far from the expectations that had been legitimately created. The profile I was introduced to did not correspond to the criteria I had clearly defined in writing. I also discovered that this person had not paid for a membership, which creates a fundamental imbalance.
Furthermore, certain elements lead me to question the exact conditions under which this organisation operates. The Paris address indicated in the contractual documents, presented as a point of contact, did not in reality correspond to any identifiable office when I followed up, and appears to have changed since.
Despite my repeated attempts, no satisfactory solution has been offered to date — no refund, no goodwill gesture.
In light of this experience, I strongly recommend exercising the greatest caution before making any commitment: it is essential to examine the contractual terms in detail, the actual functioning of the service — in particular who pays and who does not — as well as the structure as presented.
