Gaucho - Liverpool Branch
I traveled to Liverpool to watch a football match, and due to a change in my return plans, I had to cancel the reservation I made two days earlier. However, they still charged me for the booking even though I notified them at 1pm about cancelling an 8pm dinner reservation, which is not strictly well within their 24‑hour cancellation policy but is still enough time . I don’t believe this reflects ‘fairness’, as I don’t see how the restaurant has incurred any genuine loss. They almost certainly re‑filled the table, so there was no financial impact to them. On that basis, this clause in the cancellation policy appears to be an ‘unfair term’, which I intend to challenge. I will also be pursuing this under Section 75 of the Consumer Credit Act.
Additionally, the experience during the cancellation call was quite poor—the tone felt rude, as if they rely on cancellation fees rather than genuine customer service
