My Trademark Was Registered on the First Try!

Overall, the reviews for Trademarkia seem to be mixed, but my experience was great! Maybe I got lucky with my assigned attorney.

Andrea Gorrie (my attorney) was top tier! I had soooo many questions, and she answered them all. Her advice was solid, and she got my trademark registered on the first try.

Professional support for UK trademark registration

They charge you massive fees for their incompetence

I've gotten 4 patents and a few trademarks over 10 years. Their incompetence has cost me over $9,000 in wasted fees and re-filings. They file it wrong due to incompetence despite all the correct information being given. They made the same mistake with me 4 times in a row for my patents. I gave them an ultimatum to pay the government office action fees due to their mistake and not to charge me their $1200 fee, that i've paid the previous 3 times. They agreed not to charge me their $1200 fee this time, but they refused to pay my government fees. I've given them so much money over these years and gave them a chance to save our relationship. They chose $636 over a good customer. They are passively negligent and if you ever have a problem due to their incompetence you won't get help. Even a customer of 10 years won't get help. I wished them good luck and I hope they take care of the next customer better. I'll figure out a new option. They just don't care about us even when they mess up - its like delaing with amateurs when they should be professionals.

They ask for more Money after you pay!

Probably cheaper firms out there, as these guys charge first 799 and then they ask you for 100 bucks to do they job again which pissed me off! Can not recomend, google another firm!

Scam

I requested a quote for TBA, but what I got was just a $3,000 demand .. no hourly rates, no total budget estimate, nothing. This feels like a total scam. Can’t believe businesses like this still exist today.

For this reason, hourly rates or total budget estimates cannot be reliably provided in advance.

The $3,000 amount referenced is an initial attorney retainer, not a demand or a total fee. This retainer is applied toward legal work performed by a U.S.-licensed trademark attorney and allows counsel to begin reviewing the matter and advising on appropriate next steps. Providing a guaranteed total cost at this stage would be misleading, as TTAB proceedings can escalate, narrow, or resolve unpredictably.

Be aware, they will make you pay for their one mistakes.

We got a rejection from the Trademark office for a description, they approved and corrected, and they said I have to pay another fee for simply replying back with clarification that the Trademark office suggested. $1500 for a reply. It's a rip-off, especially considering that it was their responsibility to do it correctly the first time, which is why I hired them in the first place. When I confronted them, they have quicly withdrown power of attorney and wrote this to me:

I won't discuss the matter any longer as we aren't your attorneys anymore. You have a different opinion. Our work was done. When you are ready, please let me know what you'd like to do with the rest of your portfolio.

Per the USPTO, trademark registration is not automatic or guaranteed. Each application is independently reviewed by a USPTO examining attorney, and Office Actions requesting clarification or amendments are a normal part of the process. These determinations are subjective and may vary by examiner.

In this matter, the application was prepared by counsel, provided to you for review, and filed only after you electronically signed the USPTO declaration confirming the accuracy of the information, including the service description. After filing, the USPTO issued a non-final Office Action requesting clarification and a standard disclaimer. This does not indicate an error in filing.

Responding to an Office Action requires additional legal analysis and attorney time and, therefore, constitutes a separate legal service beyond the initial filing. You were also advised of available alternatives, including proceeding independently.

You indicated to your attorney that you wished to respond without attorney involvement. In accordance with USPTO rules and professional obligations, representation was withdrawn based on that request.

What They Did to Me (And Could Do to You)

THE EXECUTIVE SUMMARY Trademarkia (LegalForce RAPC) accepted $3,415.50 from my Belgian company.

Filings with USPTO: Zero (Admitted in writing).

Government Fees Paid: $0.00.

Refund Status: Withholding $1,395 of unearned fees.

THE TRAP (Why EU Founders Must Avoid Them) They accepted payment for a standard "In-Use" filing without performing basic due diligence.

The Context: In the EU, a "private sale" (B2B) allows you to file a trademark immediately. In the US, this is often insufficient; the USPTO demands "public marketplace" evidence.

The Negligence: As a cross-border firm, they know this difference. Yet, they sold me the cheaper "In-Use" package without warning me.

The Switch: After taking my money, they revealed that my private B2B status meant I had to file "Intent-to-Use" instead. This path doubles the government fees.

The Violation: By failing to disclose this material cost before payment, they trapped me in a contract with hidden fees, violating EU Directive 2011/83/EU.

PRE-EMPTIVE REBUTTAL: Why Their Excuses Are Invalid I am writing this section specifically because I know how this firm operates. They will attempt to justify retaining $1,395 using three standard excuses. Here is why each is legally invalid:

1. The "We Provided Legal Advice" Excuse

Their Claim: "We billed for the time spent reviewing your case and advising on the Intent-to-Use requirement."

The Reality: You cannot bill for "advice" that was only necessary because you failed to disclose material differences (EU vs US standards) upfront. Revealing hidden fees after payment is not legal work; it is a sales correction.

The Law: Under California Rule of Professional Conduct 1.5, a fee is unconscionable if it is disproportionate to the services performed. Retaining $1,395 for a "video analysis" that delivered zero filings is an unconscionable fee.

2. The "Client Delay" Excuse

Their Claim: "The applications expired because the client delayed signing."

The Reality: There was no "delay." There was a refusal. I refused to sign because the terms materially changed (double fees) after I paid.

The Law: My silence was a rejection of a "bait-and-switch," not negligence. You cannot claim you "earned" a fee for an application you let expire without paying a single cent to the USPTO.

3. The "Terms of Service" Excuse

Their Claim: "Our Terms state fees are non-refundable once review begins."

The Reality: Terms of Service do not supersede Statutory Law.

The Law: As an EU consumer, I am protected by Brussels Regulation (Recast) 1215/2012. A clause that allows a vendor to keep 100% of payment while providing 0% of the deliverable is an "unfair contract term" under Council Directive 93/13/EEC.

THE VERDICT On September 22, your staff admitted: "Applications unsigned and have since expired. Government fees remain unpaid." You admitted the work was not done. Stop hiding behind invalid excuses and refund the $1,395.

Avoid this company - they are scammers. They set multiple websites:

- legalforcelaw
- trademarkituk
in a way to try to gain your business. They send emails claiming your trademark is going to be taken, pressuring you to use their services, when the information is completely false.
I would imagine that they website is full of false information.

Very bad company

Very bad company, very bad product, horrible support. I joined the $29 monthly membership to help determine trademark registerability. The system is frozen, non-functional. Customer support does not answer phones, respond to chat, or help in any way. This is a bad company to work with. Avoid.
