If you are a South African expat planning a large currency transfer, I strongly advise exercising caution before engaging with Smart Currency Exchange. My experience, also supported by other views on this platform indicates that they rely heavily on verbal agreements over the phone to lock clients into contracts. Smart Currency did this to me too without conducting the necessary due diligence to ensure the transfer is legally viable under South African law.
The fundamental issue is that Smart Currency Exchange does not operate a local ZAR-denominated bank account in South Africa. Instead, they require clients to transfer funds directly into their offshore UK Barclays ZAR account. This setup caused the transfer to fail, despite the fact that I had fully complied with my obligations by securing my South African Revenue Service (SARS) tax clearance (TCS PIN) to legally remit the funds. Because the transfer exceeded the annual single discretionary allowance (ZAR 1 million), South African banks require funds to be converted to foreign currency before leaving the country. Consequently, my local bank formally declined to process the transfer, explicitly citing strict South African Reserve Bank (SARB) Exchange Control regulations regarding "Source of Funds" and third-party offshore restrictions.
When I informed Smart Currency Exchange of this regulatory block, they suggested I simply open a new local resident account. As a UK resident, this is legally impossible, as I cannot satisfy South Africa's FICA requirements for proof of local residence.
Despite providing written evidence from my bank detailing these legal constraints, the firm's compliance team was entirely dismissive, stating that understanding these banking regulations was "beyond our scrutiny." In my view, as an FCA-regulated broker, this demonstrates a severe failure in their Consumer Duty by selling a contract that was legally impossible to execute from my own accounts from the outset.
Rather than acknowledging that the transaction was frustrated by genuine regulatory hurdles completely outside of my control, they issued a "take it or leave it" ultimatum: find a way to settle the contract or face a substantial cancellation penalty. Faced with the threat of aggressive legal action, I was forced into a highly stressful workaround under significant duress.
Save yourself the distress. I highly recommend finding a broker that thoroughly understands international banking laws and can actually facilitate transactions through a localized South African bank account.
