Great at first but quickly became a nightmare

It has been a year since I completed on my shared ownership property with Humphrey’s. I have waited some time to write the review so that we can all know that it is of sound-mind and not an angry rant. Initially, my experience was in-line with all the positive reviews on this page but it quickly turned sour and Humphrey's quickly became a major issue for myself and my sellers.

The flat that I was trying to purchase had some caveats that put off a number of lenders, my broker was effectively 3rd time lucky in finding one. We all know how long dealing with one lender can be, let alone 3 lenders at the beginning of the interest rate rises. My solicitor (who is named often on this page, but I think it is unfair to name and shame) was very proactive to begin with but once month 6 of the whole fiasco came, they very quickly began to not care.

The issue was absences were not communicated, nor was the case passed on to another colleague. I emailed and emailed only to be ignored, then finally I received an annoyed message telling me that they were OOO and reply when they’re back. An automated OOO response would have sufficed. From this point I would often not receive replies from my solicitor, I only received an email when they felt they should message me. It felt like the client should only “speak when spoken to”. Eventually, I was annoyed enough to send an email to their general inbox asking for updates, this was responded to directly by the MD themselves, who was aggressive and stand off-ish. I don’t think any client should ever feel like they’re trying to be intimidated.

It often felt like my solicitor was prioritising their own professional standing rather than serving the client. I discovered this when my solicitor friend assured me that I could ask them to move on from small points. When I tried to do this because I felt the completion was being held up, I was ignored. Only for a week later my solicitor to say that “you don’t ask, you don’t get” when a particular bit of information arrived. It’s worth noting that my solicitor friend said that this behaviour was unusual and not client-serving. My sellers said that no other resident in the building had these points raised an obsessed over, now that I’ve been there for a year and have spoken to my neighbours, I can confirm that that is the case.

It’s worth mentioning that at this point my girlfriend and I were stressed out and in temporary accommodation, all signs said that we were weeks, if not days from completion. Due to slow lenders caused by the interest rate rises caused by the war in Ukraine, all delays were amplified. Being ignored by my solicitor when I asked them to drop the point cost me another 2 weeks before completion. What should have been July completion became a late September completion. My sellers even took the risk and completed on their next home, paying for two properties over July - September as they knew we were just being held up on a few tiny points.

I ended up contacting my sellers solicitors (Setfords) for advice, they were incredibly understanding, supportive and allowed me to speak directly on the phone (something Humphrey’s do not allow). They agreed that I wasn’t being listened to and that my solicitor seemed to be doing their own thing, but advised that I was so close, changing solicitors would not help.

I hope my review is thorough enough to help you make your decision as to whether you go with Humphrey’s. I would say the risk of following in my path is not worth it. PS - I’ve seen people claiming that negative reviews are often suspiciously deleted on this page…. If that is the case. I will post again. Thanks!

Baffling how these like to argue with reviews...
Secondly, how vile is it for your solicitor to quote private correspondence ON A PUBLIC FORUM.

I was polite and said thanks even though you guys were the bane of my life. I think you'll find I did complain when I was sending emails to the whole company asking where the hell my responses were and having to deal with your bully of an MD. They say they offered to drop the point, but that was after emails and emails of me asking, by which point they got the response they wanted. I won't sit here an argue because it's beyond petty and is like dealing with a child who won't be told off. I just encourage you all to not bother with this company.

Sorry to read this, but have now looked into it.

You were buying a shared ownership property. We were engaged on 2.12.21. The transaction completed on 22.9.22.

You tried to get 3 different lenders to lend to you:

The 1st offered but then would not accept the lease's re-sale fee clause. The selling housing association (HA) would not remove it. They later changed their mind, but you already had a new offer from a 2nd lender.

The 2nd lender later withdrew its offer as the HA notified us that the property had no External Wall System Fire Review Certificate.

You then received an offer from a 3rd lender and it was with these that we completed the transaction on your behalf.

From the outset until 23/8/23 you received multiple emails from our team updating you on the legal work on the transaction, acting for both you and your lender. You expressed no complaint during this period. On 23/8/22 you wrote to our team: "Truly, interstellar news! Do you know what the coming timescale will be? I’ll notify the sellers."

Our report on the transaction, with all its key documents, was to be sent to you shortly before intended exchange of contracts. On 23/8/22 Ms Hearn informed you that this was in draft with her supervisor for review ahead of its being sent out.

You told us that you were under pressure from your sellers, the HA, to exchange contracts. That's what sellers do.

You had, we understood, against our initial advice, ended your existing tenancy before contracts were exchanged so you were in temporary inconvenient accommodation.

On 1/9/22 you sent a complaint as to elapse of time.The same day the partner replied:

".. it does not .. appear to me that an elapse of time of 5 or 6 working days between .. 22nd August when you were sent that email to today 1st September, in late August, around a bank holiday, is an unreasonable time period."

The review identified an important deficiency in the lease which we put to the HA's solicitors acting both in your interests and those also of your lender: "Parking space is not defined in the Lease, nor is it referred to in the definitions for Common Parts or Estate. Please supply a deed of variation to remedy this."

You asked us to drop the point, against our advice, but we could not do so as acting in your lender's interests.

The other side then supplied a marked-up plan showing your parking space. This was enough but we advised you: "On balance, we will drop this enquiry with your instructions and it will not be necessary to incept indemnity insurance. However, this does not mean that your buyer on a future resale will not query the parking space arrangement ..

In many matters of negotiation, if you don't ask, you don't get - in this case, we asked, and we got. You should file this marked up plan somewhere safe to refer back to at a later date (a copy will be enclosed in our report on title also)."

On 7/9/22 we sent you our full report on the transaction. The earliest date your lender could complete was 19/9/23. We received from you on 13/9/22 the signed documents.

Meanwhile, Ms Hearn had been unexpectedly absent for illness. You raised concerns about meeting what was now, because of the bank holiday, the 22/9/22 completion date.

Ms Hearn, despite being absent ill, emailed you, for which you thanked her, about meeting that completion date.

Contracts were exchanged and completion occurred on 22/9/23. We so notified you and you emailed: "Brilliant. Thanks for all your work on this."

You did not then raise any complaint with us until now through this website.

We do not see that our team acted unreasonably/with undue delay. The obstacles overcome needed (by you and your lender) to be overcome. Time elapsed in doing that.

Nonetheless, if you email lawyers@humphreys.co.uk to ask for our formal Client Concerns Procedure, then we will engage with that and report to you with a more detailed review of the file.

We had a really tricky shared ownership purchase, and Olivia, Yasmine and Tom helped us out immensely. They were relentless in chasing and communicating with us when we needed to input.

Shocking client care

NB - check Google reviews as Trustpilot reviews can be removed!

Do NOT recommend this firm. They have zero communication skills with their clients, Fo not speak to clients (twice in the 8 months only) and ask you to email but then don’t respond. Bullying and threatening to drop you as a client emails from the owner. One star is a high score for the worst solicitors I’ve ever had the experience of in over 60 years!
I’m expecting this review to be removed from Trustpilot after a ranting response!

You were not our client in this transaction. You are our client's mother.

Nonetheless, you interjected into the transaction correspondence throughout.

What happened here is as follows:

The was a new build shared ownership purchase case in which we were instructed on 30/11/22.

The sticking point in this case was that the Section 106 agreement did not have in it an indemnity clause or a clause that that excluded the liability of individual purchasers or their mortgagees and successors. This was initially raised by our team on 19/10/22 as we couldn't source an indemnity policy for breach of s.106 given that we were dealing with a new-build property.

The selling solicitors refused to enter into a deed of variation or to provide a deed of indemnity indemnifying our client and we received their final replies on 2/12/22. We reported to our client's lender on 9/12/22.

The lender was not content to proceed on this basis and requested further information which we had to provide before we could complete the matter.

Our team sent 40 emails to our client between 5/12/22 and 24/2/23 which is when the matter completed.

Both our client and you her mother were made fully aware of the above.

Efficient and communicative

Natasha Hearn was efficient and communicative throughout. She handled a shared ownership sale with three parties (buyer; seller; housing association) very competently and we got the job done on time & on budget despite the housing association being typically slow / rigid.

Not all transactions run smoothly, not least because the title to the property on offer, trying to be sold by the selling side, may not be without deficiencies or defects which it can take quite a bit of time and resistance from the selling side to overcome, putting the title to the property into a state in which a lender can be advised to advance its loan monies on the security of the property.
