120 Day limit for chargeback request

I contacted Barclays today about a chargeback request, was told theres a 120 day limit. My orders were Dec '16 & Jan '17. Barclays asked why I hadn't requested a chargeback sooner, all I could tell them was the standard Spin excuse "release date had gone back". It didn't help my cause any!!

My recent email communications...

My email to Spin yesterday after receiving their note re ceasing trading and appointing liquidators....and a reply from the administrators:-

I can't tell you how disappointed and angry I am to have received your email yesterday, particularly after having spent over two years chasing you and listening to a catalogue of excuses regarding the non appearance of products I've ordered, and for which you have conveniently (for you) taken my money for.

So, some questions and instructions for you to act upon before I pass the case onto the Police fraud dept and TSO. Firstly, as you are still legally trading for another 5 days have 3 options for you:-
Please either send me the outstanding item I ordered (if you have it) - which you last claimed in your email of 7th Aug (see below) you'd be receiving 2 months ago!
If not, credit my card with the amount you took on the 13th October last year, plus 8% interest for the period you have had my money i.e. a whole year.
Alternatively, provide me with a list of items you do have in stock (I presume you have obtained some with all this cash you've received), so that I can choose a suitable replacement.

Having read about your appalling trading practices from numerous of your loyal customers on various online review websites, it seems there are many people, some of which have paid you hundreds (and, in some cases, even thousands) of pounds or euros for products you've failed to supply…so, I have to ask, where is all this money? Surely it was ring fenced purely for the process of buying in new stock for products you advertised; with your (small teams') wages being paid out of your profit margin on said products?

After resolving the bulleted points above, and using the Freedom of information Act, please provide me with the following:-
The date you last took a phone order (unlikely as nobody ever answers) or online order of any sort.
The overall number of customers you still have outstanding orders to fulfil and a rough amount of money you have taken from them, in total.
Also, your business accounts submitted for the most recent period.

Finally, I have to say, it is most unfair, but seemingly normal for you, to suggest that the onus is on us, the innocent party, to spend even more time arranging 'chargebacks' via our credit card supplier. I'm sure you are fully aware that some operate a cut-off timescale and minimum amount reclaimable.

Let's see if you can redeem yourself in some small way, at the 11th hour - I look forward to your prompt, courteous response, by return.

The directors have taken steps to place the Company into Liquidation. We attach a copy of the notice sent to creditors for your information.

The decision process on placing the Company into Liquidation will conclude on Monday 15 October 2018. We will write to all known creditors within 7 days of this date to provide confirmation of the appointment of Liquidators and further information for each class of creditor, including consumer creditors.

In order for us to collate details of your claim, please complete the online survey which will provide us with more details of your claim.

You will appreciate that there are a number of claims being made against the Company. At this time it is uncertain whether sufficient funds will be realised to allow a dividend to be paid to any class of creditor. You may wish to contact your card provider/bank to identify whether they are able to facilitate a chargeback request, where appropriate.

Having now spoken to Baldwins on the phone, I have suggested that instead of gathering info from David Dodds they should talk to his customers to gain a true reflection of how he actually ran his business.

Officially out of business, what now?

Further to my report of last month, Spincd has now announced thru its accountant that it has ceased business. The announcement helpfully suggests that customers who have paid SpIncd for undelivered goods seek repayment from their credit card companies. This will not be possible for many customers due to the length of time passed since the credit card was charged---the standard Spincd refrain was "delay due to supplier" or "release postponed for 6 months, just wait and we will send it".

The point to keep in mind is that what happens to the Dodds, husband and wife, who owned Spincd and Steve, its frontman, depends on your activity. Bankruptcy protects the limited liability company from having to pay you back BUT IF A FRAUD INDICTMENT IS ISSUED, A GUILTY VERDICT WOULD ENTAIL THEIR PERSONAL LIABILITY FOR THE MONEY THEY TOOK. Then they might have to sell their yacht, mansion. dip into that huge bank account, or defraud some other people so that all of you 1000s of "suckers" can be repaid.

Got over £100 in unfulfilled orders…

Got over £100 in unfulfilled orders back through Chargeback. A couple of years ago they sent me a standard edition of a Joe Jackson cd rather than the deluxe dvd edition I had paid for; never received the correct edition but guess I'll have to write that one off.
Surely the liquidators will pick up that they've been taking money upfront for several months with no intention of supplying the item? If so, aren't they duty bound to report them to the proper authorities?

Just surprised we're not getting a 20% off code at the moment- use code LIQUIDATE20 for example!

a terrible, lying and deceitful company

a terrible, lying and deceitful company to deal with. They owed me at one stage GBP310. I took them to the small claims court and they managed to pay me back some of the money whilst this was in motion. GBP100 is still outstanding so I have now had a CCJ initiated against them

A horrible situation,

A horrible situation,

I ordered 2 boxes in 2017 and till this moment I didn't receive anything. The costs were about 50 pound. I was told that I had to wait a while, but I think it will be for eternity. One way or the other the people behind Spin have to pay for this bad situation.

Lost 60 quid .

Lost 60 pounds . Ordered June 2018 . Poor response to emails and broken promises . Asked for refund which they agreed to in July . Never heard from them since .

if you care to read some of my reviews, you will find i have been trying to find out what these fraudsters are up too and putting all the relevant info on here in the hope everyone else will do the same!
I have also been in contact with trading standards by sending recorded letters etc and now the next step is the small claims court!
I agree everyone should now report to the local police station as a crime and just maybe something will happen!
i have also approached my bank with a charge back on one of the orders too!

Do not use!

Do not use! I don't think you can now anyway. I ordered a CD from them in June. Unusually for what l thought was a reliable Company they took payment up front, not when they had it ready for dispatch. I emailed and and as usual got no reply. It seems the shop has now gone out of business, the shop closed and the proprietor has done a runner. A One Star rating is too generous for this outfit! I have now contacted my credit card company and have obtained a Chargeback refund. I advise everyone who paid by credit card to do the same.

Deceitful and dishonest people.

Another 1 star awarded. One star too many. This year I had pre-ordered two box sets, total value £551:98. After the items had been released I began to make enquiries about their delivery. When Steve was still answering the phone (and replying to e-mails two weeks after), I was fed the company line - still awaiting delivery, good prices but slow delivery. When I read the writing on the wall that I would never be receiving the goods, I phoned and emailed requesting a refund - all ignored. Even a signed for letter was delivered, signed for, and ignored.
I urge everyone that is owed money to request chargeback from their bank. Fortunately it worked for me and I was refunded. It took some time though I can only hope the refund was from the account that the funds were paid into. Overall an unpleasant experience, but, (f.a.o.Spin), what goes around comes around. And I have reported to Trading Standards and BBC Watchdog.

Same as everybody else

Same as everybody else. One star seems two stars too many !!!!! Ordered Clapton box set, Dylan vinyl, Dylan cd box set, Eagles box set and so on. Only thing that did arrive was Gram Parson box set in the sale ………. how weird. Clearly selling stock they did not have

Contacted my bank, filled in a form, all monies refunded in 10 days. Phew guess I am one of the lucky ones

Contact your credit card company to get the refund

Well, folks, there is only one advice I can give. If you paid by credit card, request a charge-back from your credit card company. That is what I did and it worked - of course, that was a few months ago before Steve disappeared. The customer service has always been dodgy, with the slogan 'pay now - get goods later (if you are lucky)', but I cannot see why anybody would wait for six months to get the goods after they have become available everywhere else. This was my case, I tried to cancel and get refund, but to no avail. So my credit card company then did the charge back.

Low life robbers.

I have two back orders from Feb this year. I was unable to get hold of them, the answer phone saying, we are very busy try again later. I could not get a reply from the loads of emails I sent. They are just a bunch of low life robbers.

Really BAD Customer Service

I ordered a Box set when advertised from them in January 2018, release dated scheduled for the following month (February).
Money taken on the date of the order placed (of course) !
I chased them up several times because of non delivery and actually spoke to a guy (presumably David Dodds) mid July this year, and he promised that it would be with me within 2 weeks.

Well …………. the same problem as with everybody else.
Tried e-mailing them and No response, not even an acknowledgement.

No delivery, and you can never get through to them within the advertised opening times (Mon - Fri 10:00 -13:00 & 15:00 - 16:00), the answerphone is permanently on and automatically terminates your call , rather than place you in a queue, therefore your chance of it being answered is extremely low.
So the outcome is that this is STILL OUTSTANDING !!!!
I have spent countless hours trying to get through and in excess of 350 calls. PLEASE, PLEASE, PLEASE Avoid this company like the plague.

Just read a previous review from a couple of days ago which may be of help to other ………….

I had the same problems with spincds

I had the same problems with spincds, I made two orders with over 80,00 euros, that was last April, I never received my orders and still waiting for the refund. I hope that there's in UK some kind of office that can solve such problems.
