We had a chance to have a lesson with…

We had a chance to have a lesson with shaykh salem till noe. Its been almost two years and Alhamdulillah every week benefitted a lot. The institute is working hard with sincerity, professionalism toward quran and sunnah. May Allah bless everyone there. Amin.

Extremely rude and unprofessional

This is one of the worst madrasahs I've ever had to deal with. I've been very unhappy with the progress my child has been making, so after months of deliberation I decided to cancel.

However, after cancelling the direct debit, Al Haramain Institute reinstated the direct debit. So I contacted them and told them I want to cancel, but they said I cannot cancel for personal reasons and that I am bound by the terms and conditions. I told them that they have not been fulfilling their side of the "terms", as the quality of teaching has been very poor, but they still say that I cannot cancel and I must pay for the whole year.

I then asked for proof where I agreed to the terms and conditions, so they sent me a screenshot or picture of a signature which wasn't even mine, and they said that it was sufficient proof that I had agreed to the terms (for 2021/22). When I asked them whose signature that was, they deleted the message (on WhatsApp). However, I knew they would do that, so I saved a copy of it before I asked the question.

They then sent me a picture of a signature dated the year before, which did look like mine. However, I pointed out that it was from the year before, in 2020. But they stubbornly claimed that whatever I agreed to in that year would apply so long as my child is learning with them!

So why is it that every year when the academic year ends, they send out new terms and conditions that every parent has to sign, and parents have to apply to re-register their child? Because I signed up late, it's possible that I wasn't sent anything to sign – I certainly don't remember signing anything for this year.

So as it stands, I cannot recall agreeing to the terms in '21 and there's no proof that I signed anything, so I am not in any contract for a year. Hence, I can cancel anytime, which I have done. But they continue to take payments without our consent, even though I have warned them and told them to fear God and not take any further payments without permission. But they still do it and keep applying to reinstate the direct debit.

Once you give them your payment details, they save it and take payments however and whenever they please. They claim that this is what one agrees to when they sign and agree to the terms and conditions. One apparently gives them "irrivocable" permission to use one's payment details and full authorisation!

I once asked for a studies pack to be sent out to me but they said it would be chargeable. I didn't mind, so I said please let me know and I can call back to make the payment. Weeks later, I found out they just took the payment directly from the bank using my payment details. Others have said the same thing and have been victims of their zulm and transgression.

It also says in the terms and conditions that in the event that they are unable to provide a service, due to some kind of unforeseen circumstance, you will still be required to pay the fees for the year and the obligations placed by the terms will not apply to them. Have you ever heard of such nonsensical terms? So you as the parent are always bound by the terms, but not them!

May God deal with them.

Final update

They frequently keep editing their response. Unfortunately I am limited in characters to respond in full. So very briefly:

I had been registered for a year and that academic year came to an end. The following year, I "re-registered", but I didn't agree to any terms, whether verbally or written. The only proof I was given was a picture of a signature which wasn't even mine, and they claimed that was "sufficient proof" of my acceptance of the terms.

I did not use any blackmail. I simply informed them that I would be leaving a review of my negative experience, because people have the right to know.

They stopped communicating with me and said that if I wanted to discuss further or request a copy of the terms, I should send an email to their generic email address. I requested to speak to management instead, but they did not reply. That's when I decided to leave the review. A week later (after leaving the review) they replied.

In terms of being truthful, I am not the one who deleted messages from the conversation and sent someone a signature which isn't even theirs, claiming it's proof they've agreed to the terms.

They claim to be an Islamic organisation but their hypocrisy has really become manifest by deciding to take the matter first and immediately to English courts. This is a matter that can be very easily settled by a Shari'ah court, imam or qadi, but they're not interested in that. Sheer hypocrisy. Please read the Qur'an, 4:60.

We have checked your user name against our systems, your comments are false and it is unfortunate that you had to write a public review and provide a 1 star rating based on a non-genuine experience and false exaggerated ill-intentioned statements in what we strongly believe engineered to be used as a form of blackmail to forcefully relieve you from the contract (which is Shari’ah compliant and legally binding) that you had entered into and fees you owe for services delivered and still being delivered. It should be noted that you have been registered with us under terms and conditions as a parent for 2 years, at your own will you registered for another year following your satisfaction or our quality and services the previous year, Trust Pilot is not a tool for blackmailing which you have attempted to use stating in Whatsapp messages to us to suggest unless we cancel the remainder of the agreement (not pursue you for fees that you have agreed to pay in the contract) you would post a negative review on Trust Pilot, having checked your Trust Pilot account it’s interesting to see that you have posted reviews 8 times to 8 companies of which 6 are 1 star calling them scam, appalling service, dreadful, worst housing etc which clearly goes to show your attitude towards companies and that perhaps there are issues with yourself you need to reflect upon, it is also interesting to note since our comment made on this you have been working to increase your reviews on companies at a fast pace recently in an attempt to portray our statements not to be correct. Unfortunate for you we do not rely solely on Trust pilot and our excellent reputation speaks for itself including on Trust Pilot.

We are investigating this review and shall use it as evidence, it is unfortunate that Trust Pilot verifies only that there was some contact between the reviewer and company in order to accept a review but does not check nor gets involved in checking the authenticity of the content of the review or experience, the matter is not about you having the right to share your experience which is a right everyone has however the issue here is that this is a false nongenuine interpretation of the experience engineered to be used as a form of blackmail for you not to be perused for fees you owe having entered into a service agreement with us (with a commitment of 1 academic year) while harming our reputation and attempting to deter others away from us for your wrong ill-intentioned doings in not respecting the agreement you are in, these actions are unIslamic/sinful, classed as clear defamation and you maybe liable to pay damages for along with the fees you owe breaching the agreement and legal costs if pursued legally and your review shall be used as evidence in such a case.

Due to your thuggish, forceful and disrespectful approach from the beginning of conversation, against the norm of how we treat and deal with parents we had taken a firm and formal approach with you advising you to write to us through email rather than Whatsapp to make formal communication with us, and you have avoided till this day:

You then mentioned Trust Pilot two times 3.05pm and 3.12pm and its clearly mentioned in the form of blackmail to indicate because we are not cancelling agreement (which is our right according to agreement you entered into) to expect a negative review.

As for your false claim that we had provided you a forged scribble signature, we have already explained to you there has been no forgery and this defamatory statement will be included in any claim against you, your behaviour in continuously attempting to escape liability of agreement is expected however twisting the facts (which is all evidenced in writing) with the intention to deter others and cause us harm while being dishonest is unacceptable and not expected or respected in Muslim dealings. The facts are you asked for a copy of the agreement then had found a version online and initially began by attempting to claim it was badly written or unclear (first attempt of escape), you were advised that you had agreed to terms of agreement and there were copies provided to you which was available on your online account and additionally it was sent to you before usage of service and prior to acting on the agreement this year, you have confirmed receipt of it in writing in messages to us. On your request you were sent an image of your signature confirming that you have agreed to the terms of usage of service when opening a parents account with us, you now claim it 'looks' like your signature and this claim comes despite the fact of using the same account to access and take benefit of our service for near 2 years (records of which we hold), then you claimed you agreed to the terms of previous year and not the current year because you did not sign anything for this year (strange claim to make especially as somehow you have been using our service and paying for it without any issue for over 5 months into the second year supposedly without any agreement), we then advised you how the parents accounts work and the fact even if you were not to sign with signature at all (despite the fact we hold a signature of yours) you are bound by the terms of use of our service as you only sign once at beginning of account opening and you are not required to sign every time a service /course is added each year ( a little like many services, even with Trust Pilot you have agreed to Trust Pilot terms of service prior to you making these false defamatory reviews with intention of blackmail, you had agreed once to their terms of service and are not required to agree or sign each time when reviewing or every year) while we have the right to update the terms, we provided you updated copies which you confirmed in messages writing that you did receive it, also we have third party evidence to prove you have received it, copies of which we had also provided you before entering into and using the service.

We have given you the opportunity to resolve this matter directly with us (internally between Muslims) before we consider or initiate legal proceedings, we advised you of the consequences of any uncivil and untruthful actions (such as this review) once you attempted the blackmail, please be advised we have now instructed our legal teams to assess/initiate legal proceedings against you for false statements with the intention to harm our excellent reputation (which we believe you have done as a form of blackmail, messages we have on file) as well as pursue you for breach of agreement and unpaid fees that you have agreed to pay by registering with us. With regards to direct debits, you had entered into a 1 year commitment agreement taking the option of paying the full fees on a monthly direct debit with permission to charge your account until the full fee was cleared just as you did the previous year, this is not at all a monthly option for you to simply discreetly without any raise of concern or discussion with us cancel the direct debit and assume that it will automatically cancel the agreement and the 1 year commitment made, the agreement and commitment is one and direct debit is just a mode of payment for the agreement, you cancelling direct debits which you have authorised us to setup and take fees from for the last 1 year and 5 months is not important to us, the matter can now be escalated and fees be obtained via the claims court due to breach of agreement which shall be more costly for you having you pay the fees, legal costs and finances for damages due to defamation. In your interest we advise you to rectify your mistakes and remove this review which is not a true representation of your dealing with us based on the agreements you entered into for exchange of services, and services you have benefitted from for near 2 years.

Although it may seem we are taking a firm and formal stance against you, it is solely due to the approach you have taken and we have attempted to allow you to fix your mistakes, to date you have not been cooperative. We would like all to understand that our culture as an organisation with all parents is welcoming, kind, polite while being firm upon professionalism, agreements, terms and conditions. We are different from most other Madrasahs as we have advanced technological systems and policies in place to ensure a smooth streamlined operation and delivery of a formal professional and quality service. We do understand some members of the community like this reviewer still requires some time for further understanding and development in dealing with professional 'Muslim' lead organisations especially as they are still used to the traditional/cultural systems and methods which are not necessarily good Islamic practices in current times. It is incumbent that we as a community advance together and learn how to deal and behave in a civil, professional and Islamic manner with each other especially after clear agreements and terms between two parties with full authorisation have been made.

Allah Azzawajjal says in the Qur'an:
"O you who have believed, fulfil [all] contracts"
— Surat Al Ma'idah Verse 1 (Saheeh International)

If one misunderstands or is unable to keep up with their part of an agreement, that is understandable and in most cases we are considerate beyond the terms agreed to, the correct way to approach the matter (as we have advised you on messages) is by raising change of circumstances as a request formally (not obligation on us) for consideration, rather than not only just breaking one's agreement which is Islamically wrong but also attempting to blackmail, force and defame us due to your own wrongdoings, surely you would not do the same with non-Muslims companies, then why with Muslims? these ways of behaviour must change and is unacceptable as a Muslim.

As for hypocrisy and us immediately going to the courts, this is false, we have attempted to resolve your behaviour directly between Muslims with you, given ample opportunity and advised what we will be forced to do if you do not cooperate, we also hope you will accept the fact for you to use Trust Pilot agreeing and accepting their terms of usage in order for you to make this very false defamatory review against a Muslim organisation accusing us of hypocrisy while in Whatsapp messages to us stating its Kufr to use any law other than Allah and all the other things you have attempted while portraying to the public you are the victim of this matter, it in itself is an extreme form of major hypocrisy from your part, for your knowledge and the records, Trust Pilot's terms of usage state that their agreement of usage by you (which you have accepted) is according to the laws and rights of judgement of the federal courts of New York:

9. Applicable law and venue
9.1 The User Terms and the relationship between you and Trustpilot are governed by the laws of the State of New York, without regard to the conflicts of law provisions thereof. Any disputes must be brought exclusively in the state or federal courts located in New York, and the parties hereby consent to the jurisdiction of such courts.

Perhaps now you will claim you did not agree to Trust Pilot's terms either and did not sign anything nor posted this review? :)

Mr Shah we ask you to Fear Allah Azzawajjal and reflect on your behaviour and actions which does not befit one of a good Muslim, unfortunately you have landed yourself in potentially some major legal and sinful issues, unless you rectify your mistakes and approach us cooperating in an Islamic manner we reserve the right to instruct our solicitors and you shall be hearing from them shortly.

***UPDATE 08/03/2022***
Due to the many false and defamatory statements the reviewer made on the original review they had initially posted, they were made by Trust Pilot to change many of the original statements (which we have saved), spending time from 6am to 9am in the morning 07/03/2022 editing 4 times. These actions of Trust Pilot making the reviewer edit/remove the comments aswell as the reviewer acting upon it as opposed to deleting the review completely is further evidence and confirmation of the false information and defamation caused, all of which we have kept evidence of and has been passed to our legal team to consider towards claims for damages. The review posted by 'Shah' above still contains untruthful and defamatory statements.

They dont even deserve 1

They dont even deserve 1, they are just lairs all they care about is money. I paid for my kids to learn in school they just changed to online learning without informing me saying its in the small print that they can change. I dont understand eveyone is going back to school but just not them. No one is listening to me when i call i am fed up with this people so i keep cancelling their direct debit and they keep setting new ones. May allah deal with them for what they are doing.
