Great buying experience, poor aftersales

I have recently bought a car from Your Best Car and can't fault the whole buying experience. Everything has been arranged over the phone etc and car was prepared and waiting in the showroom which was great. This is where it goes downhill as i have noticed quite a large chip stone on the side of the car which wasn't on the video which was sent to me before collecting the car. I was happy overall with the car so we agreed a slight price reduction and that they will sent official BMW bottle of lacquer to me. I haven't received the lacquer for pretty much 2 weeks now and i am also being ignored via whats app by the sales man. I took the car to local garages to get the quotes for the panel respray and been advised that the whole panel has been painted before where the chip stone is..... It's too late to revert the transaction from PCP and insurance point of view so just have to hope that mechanically car will be fine as I don't have any confidence that I will get any support under their 6months warranty. Make sure that car is perfect before finalising the purchase as the buying experience is very good but after sales not so much.

How to lose £5,000 in 3 days with Your Best Car

I purchased a GR Yaris from this garage and was told I could return it if I was not happy. I drove away and all was ok and I loved the car and told them to send me the v5 that they keep for a week to ensure I was happy with the vehicle. Unfortunately an injury made driving the vehicle worse and worse so on the 3rd day of having it I asked to return it using the 7 day guarantee.

I was told as I had asked for the v5 that I could now not claim to get a full refund but I could return the vehicle and get my old car back. I felt extremely stuck as my old car did not cause me any problems and I agreed to return the Yaris. They said they would only give me £22,500 for the car that I had bought two days earlier for £25,900 and I could also get my Golf back that I part ex in for £15,000 but to get it back it was now £16,000. I literally didn’t know what to do so I got my old car back losing close to £5,000 in 3 days.

I’m awaiting a response from my solicitor as I’ve started legal procedures but I’m unsure what will happen. I did email Ashley who is the sales manager there and I was met with sarcasm and not interested at all. Yes I returned their vehicle and bought my old car back from them but to take that much money when they have put their car back on their forecourt for the same money is disgusting.

I hoped they would re think and give me some of my money back but their answer was you agreed to return the Yaris and get your car back. Ashley said the 7 day return is for distance selling not for when you collect, that’s not what I was told when I collected the car !

They are saying as I asked for the v5 it voids the 7 day guarantee but it never existed in the first place if you collect. I’m very very unhappy as saving that much money to lose it to a completely uncaring un sympathetic business is awful. Their customer service if things go wrong or you change your mind is disgraceful.

Please be mindful that the 7 day return is only valid if the vehicle is delivered not if you collect regardless what you are told on the day.

Good Afternoon Rik,

I want to break down exactly what has happened for you and for our future clients as there are two sides to every story.

1. You purchased a Toyota Yaris GR RK70KNG from us, paid via Bank Transfer, and collected it in person on Monday the 13th of November from our site in Cranbrook.
2. You Part Exchanged a VW Golf GTD FL18ANR on the same day.
3. You collected your car in person. Therefore, it is not a distance sale.
4. You then Messaged Morgan that evening at 19:19 and explained you were keeping the car so please register the V5c to you. Even calling the car “Incredible”.
5. You then called on Wednesday the 15th of November and explained you wanted to return the car as it was hurting your neck.
6. Jamie explained we could buy your car back at trade value which would be £22,500.00 (£1,000 more than Autotraders suggested guide might I add). He also explained it was your car and you could of course sell it to any other business more local to you.
7. You agreed to this purchase price and immediately set off to drive 4 hours to sell your Toyota Yaris GR to us.
8. At no point were you forced or unfairly asked to sell your car back to us. You agreed to this price and the cost to sell it back to us. You even had a nearly 4-hour journey to change your mind and keep your “incredible” car.
9. You arrived with us, Jamie checked over your Toyota Yaris GR, and agreed to buy it back.
10. The only stipulation was the locking wheel nut was not present so we would hold onto £500 until it arrived back with us (this is normal procedure for any client). Jamie explained as soon as it arrives with us, and we confirm it is the correct key we will refund the remaining £500 - Which has now been done.
11. Jamie then offered you a chance to buy your old VW Golf back at £16,000.00 rather than you getting the train home. Which you agreed to do after checking over it and even making phone calls discussing it. Again, at no point were you forced to do this. We offered you a trip to the train station on multiple occasions.
12. Your Golf had been fully detailed, and machine polished ahead of advertising that afternoon. We really didn’t mind if you didn’t buy our VW Golf we were ready to advertise it.
13. After a few hours of deliberating, you signed your new invoice and drove home.

You decided to sell your car back to us Rik, no one else. What we then decide to sell our Toyota Yaris GR for, which we have purchased, is entirely up to us. We are a business and we do indeed make money on our cars, What we have it listed for is a fair price to sell our Yaris for. Again, this is assuming it sells for this price of course.

No one forced you into this Rik, we simply offered to buy your car at above market value, which you agreed to and was happy when you left us that day.

Don't buy - what you can't test drive!

So there are a few things you should know before you delve into a deal with Your Best Car.

I saw what looked to be the perfect vehicle on autotrader and made the initial enquiry via them to Yourbestcar. After a short while a very pleasant chap named Jamie got in touch regarding the vehicle. After a brief exchange I'd arranged to travel down to Kent, some 70 miles away to see the vehicle and take it for a test drive...

But Wait....Your Best Cars DO NOT ALLOW TEST DRIVES!!. Instead, the vehicle is unlocked for you to peruse at your leisure (Well, kind of..salesmen will be salesmen). So after a long drive, my partner and I were expected to buy a £40k vehicle without even driving it, how was I going to leverage a fair sales negotiation without an actual driving experience?

Jamie assured us that we could "test" the vehicle for 7 days and return it for any reason, AFTER we'd paid for it! This didn't quite make sense (unfortunately for Jamie, my background in Consumer Financial services came in handy here)....SO many questions! Firstly - Why don't you allow test drives? (And why didn't you inform me I wouldn't be able to at the start!) The questions then ventured to "What would happen to my trade in"? and "What about the hard search on my credit file"? (These push your rating down for the uninitiated!), and what about the cash elements of the deal, how do they get refunded?
Could I actually have a £40k motor "for free" for a week I thought, if for some reason I didn't like the car and sent it (well drove the 70 miles) back to Kent?

When pushed, Jamie fell into the classic sales line of "It'll all be OK". It's at this point it all started to sound a bit dodgy.. Time to investigate...

A quick search of google, and the reviews will tell you what you already suspected, examples that are a far cry from "all be OK"..multiple reviews of horrendous experiences on trying to return a vehicle from unsatisfied customers (You can read them for yourself). Customers left out of pocket, etc.
Without wanting to investigate these claims further with Jamie, The only sensible thing to do was walk away. Annoyed by the unnecessary 140 mile trip? sure. Was it a waste of time, definitely. Annoyed by the shady (slightly dishonest) sales tactics - Absolutely!

Dear Mr. Nelmes,

Thank you for your review and feedback.
I have spoken to Jamie about your review (in order to understand where we have fallen down on service here), and he was particularly dismayed to read it as he felt that you were amicable with him and got along well at the time. When you left our showroom that day you told Jamie the only reason you didn't buy our car was your Wife didn't like the colour so we are all a bit confused to see this review.

All of our sales professionals are salaried (rather than paid commissions) so it’s a shame to read your dispersions cast on our ‘sales tactics’. We had multiple enquiries on that very rarely specified Volvo XC90 you speak off, and it promptly sold just after your visit to somebody happy with our process. It had only just been serviced by Volvo and had one owner from brand new. I can only assume that your review has been placed because our process didn’t allow you to ‘leverage a fair sales negotiation’, to coin your own words.

To give a bit of background to the reader of your review. We make it very clear about our sales process. We’re very proud of it in fact. We aim to assist with ‘lining up all ducks’ before a client travels to either of our collection sites. We’re predominantly an ‘online’ dealer, and ‘all ducks’ means finance package arranged and part exchange properly valued prior to a client visiting us. Quite frankly, this weeds out the lookers from the buyers - particularly on a rare car like the aforementioned Volvo XC90 that we had multiple interested parties on. It is also extremely professional for many of our clients who are time poor and just want to buy a well priced, well specified car, that they’ve researched already on Autotrader and our own website.

With your background in consumer financial services, you’d surely understand that not all consumers can obtain a finance package, and if there’s no finance in place then no car can be purchased. This would then be a complete waste of time for everybody involved (and a waste of your fuel travelling to us). It stands to reason that - YES; you will need a credit search to obtain credit to purchase a car. There’s no mystery there - it’s just good honest fact. Many clients unfortunately fail at this early ‘credit search’ stage and we then can’t assist them any further.

A quick search of Google provides you with about 10 less than positive reviews out of a very positive 900 (on all platforms). With those odds, we’re very happy that most of our clients nearing the end of their car buying decision enjoy shopping with Your Best Car. Likewise, we’re also happy with the fact that we’re not for everybody. A Volvo main dealer would almost certainly let you test drive many different cars if this was an important part of the buying journey for you. Sadly, they quite rightly have to charge a bit more for their cars (like for like) to cover the time and risk involved in facilitating this.

We also feel slightly confused as to why you have ignored Jamie's Calls and Messages. He wanted to personally call you to try to understand at what point it went from, your Wife not liking the colour our lovely car, to you not be able to negotiate and test drive it, to then posting this review? He genuinely feels upset as to why this has happened when you both seem to get on so well on the day.

Regardless of this review I wish you well with your onward search, and ‘it will all be okay’ I’m sure, wherever you shop!

BEST OF THE BEST

Sadly I had to sell my beautifull Bmw 340i due to starting a family, needlees to say the next car had massive shoes to fill in order for me to be happy with it due to the fact i had to downsize with the engine (could not justify keeping a 3 liter gas guzzling rocket) and to have all the extras which i was used to in my bmw...OH BOY, DID THESE GUYS DELIVER!!! found a gorgeous Quattro a4 which for a 4 year old car and 63k miles did actually smell, drive and feel like new, if they would have told me the car was 1 year old, and the odometer shows 10k miles i would have believed them the car is just that good. I would like to say a massive thank you to all the team mainly Garrett, Matthew, Sean and Shane for helping me find the car that i can be happy with for many years. Exquisite cars down in theyre show room, well worth having a look and doing business with them.

**Your Best Car Successfully Sued**

**Your Best Car Successfully Sued**

In January 2022, myself and my wife agreed to purchase a Range Rover Sport from Your Best Car. Following the remote negotiations, I agreed to travel five and a half hours from our home in Chester to the Show yard in Cranbrook to collect the car and trade our 15 plate Range Rover in.

When I arrived, the salesman Jack, welcome me and we went to his office to de-register our number plate from our car and was helpful enough to give me access to his laptop to do so.

As all the documents were already completed by my wife before I arrived, I then went to check the car before I drove it home. When walking around I noticed that the tyre tread was low and it was clear that the tracking was out.

I explained to Jack that we would not accept the car in that condition and the tyre potentially ‘could’ be illegal. He refused to replace the tyre or credit me the equivalent value for a new one and I explained that we were cancelling the deal. He said that our car was not in the condition that was described and would not oblige.

I requested our £500 deposit back and Jack very smuggly, insisted that we would not be getting it back as their ‘terms and conditions’ signed day my wife said that they would charge £495 to cancel the agreement and return the money to the finance company.

I returned home and confirmed with the finance company that there was not penalty to return the finance and emailed Your Best Car once again requesting the refund quoting ‘The Consumer Contracts (Information, cancelation and additional fees) Regulations 2013’ which states that the deposit must be returned otherwise we would move forward with a claim in the county courts.

We received a very bolshy response from Ashley from Your Best Car saying that they would not be returning the money and if we did pursued them to recover the money then they would counter clam for a further £495 plus compensation for their time to prepare the car.

We lodged our claim with the courts and sure enough Your Best Car issued their counter claim.

Following a few delays due to my wife's availability to attend a zoom hearing, we attended a hearing on 10th July 2023, where we were successful in our claim and we were awarded our deposit back, plus the court and hearing fee.

The judge ruled that the clause in the Your Best Cars contract was unfair and unenforceable and made it very clear to the Managing Director Mr Woolger that it went against the Consumer Contract Regulations Act and threw out his pathetic (My view) counter claim.

It was unfortunate that we had to take Mr Woolger and Your Best Car to the small claims court to recover our rightful hard earned money, but delighted with the outcome.

We are concerned that there are no doubt other customers that have succumbed to this clause in the T’s & C’s and this is reason why we have decided to write this review. We have also contacted trading standards to inform them of the case and outcome.

I have no doubt that Your Best Car have had some very happy customers however Mr Woolger’s own LinkedIn profile states that his ‘goal is to build a reputable, recognised, modern brand within the motor industry centered on providing an 'outstanding customer experience, but from our particular experience, he has certainly failed to deliver this on occasion

We would encourage him and his team to remember his own business ethos in future disputed sales and will consider removing this clause from their contracts immediately so that no other customer is left out of pocket if they decide to cancel the agreement.

Please revert to our google review to see the picture of the tyre in question and the redacted documentation from the court proving our successful claim.

Please be very cautions when buying from this company and please check the T’s & C’s otherwise you may have to battle through the courts to get your money back!

Reply from Your Best Car

Hi Mike,

Anyway, lets add some context as we normally do to these reviews.

This all started as good old Mike did not get his own way. He arrived in his young partner’s car that was in an appalling state, and was genuinely not as described. It was like the guy turned up wanting an argument with us. Every step of the way was hard work and a fight. Despite the fact that his partner’s part exchange was in a bad way, we stuck to our agreed deal. However, Mike was unhappy with a tyre on our car and wanted a discount.

Yes, a single tyre that was absolutely “illegal” and “shouldn’t be on the road”.
A tyre that Mike wanted £500 removed from the price for.
A tyre that passed an MOT carried out by an independent garage. It passed with no advisories two days before he viewed the car.
A tyre that measured 3.6mm at its lowest point.

It’s a shame we can’t add photos to our responses to show the full independent inspection carried out by a tyre specialist, the day after Mike left us. This inspection shows the full breakdown of every tyre on the car. Spoiler alert – They were all fine with the lowest point being 3.6MM.

In summary:
Either an independent MOT test centre lied about a tyre, then we did, and finally another independent garage (A tyre specialist) - Totalling 3 experts; OR, Mike did not get his own way and doesn’t like taking responsibility. We will let you decide, although… It does seem to be a habit from some of Mike’s other negative reviews. It must be nice never being the person at fault..

As for the rest of the review, it is a nice story but simply not true and not factual.

Wishing you well with your own Businesses and future motoring endeavours Mr. Hannigan. Maybe this response will give some balance to your attacks and hopefully persuade you to move on with your own life now. However, we strongly suspect we might get the famous **Update** from Mike Hannigan on his original review…

Regards
Ashley

Excellent service, excellent cars

From initial point of contact through to final purchase was great.

Jamie was very detailed in his appraisal of the car in the video that I had requested. This allowed myself to be able to assess correctly before deciding on purchase. I am based in the north of Scotland over 600 miles from the dealership in Kent and the email/phone service was second to none. I travelled down via plane, train then Jamie came to pick me up at the final station.

The Car that I purchased looked even better in person and the quality of the valet carried out was also very high quality.

I have just travelled the 660 mile journey home with the car and it never missed a beat(early days yet). But I feel confident that the car bought will match the service provided and certainly would consider using them again.

I certainly would not put anyone off from travelling to these guys for a purchase.

Used car buying taken to the next Level.

The whole used car buying experience has been taken to the next level as it was so simple. Also the communication from Sean and Josh has been excellent especially when the car developed a fault a few hours after purchase. Josh sorted out collection of the car (I live in Wales), fixed the issue and returned the car to me. Please just keep doing what you are and hopefully you will win another award (well deserved)

Dealer refused to return my £500 Deposit

I purchased a 2 Series M Sport BMW online 16th Jan 2022 for £16,997.00 from the Kent branch of Your Best Car, initially speaking to Jack and Ben there who assisted me with the sale.
I opted for part finance (PCP) and part cash payment across 5 years.
I was told I would need to pay £500 deposit to take the car off the website and they would prepare the car for me to collect in the next days.
I collected the car and drove it back to London to test drive it. (They don't allow you to visit the site to test the car - you have to buy it online beforehand and agree to the sale)

You of course have a 14 day cooling off period whereby if you are not happy with the car and simply change your mind you can return it and they will cancel the purchase.
However when I decided I didnt want the car and it wasnt for me and changed my mind, this is when things took a turn for the worst.

The car was returned after 4 days and within the cooling off and in perfect condition, cleaned polished and with the same amount of fuel in the tank as well.
When I tried to get my deposit back which formed part of my cash advance (£6000) I was told I could not and that Your Best Car would be keeping not only my deposit but would be charging me £495 for the cancellation of my PCP finance agreement PLUS they wanted to charge me £255 for £2 per mile milage fees that I had clocked up whilst I had the car during that test driving period of 4 days.
When I demanded the full amount back, they simply replied (and I quote)
"£500 of your payment for your car was non-refundable on the basis that we stop other clients buying the car that you had agreed to buy. It also covers my Employee’s time raising your paperwork, dealing with you"

All in all I have lost £1,250.00 when YBC kept this amount stating that I was told (by Andrew Woolger (Director of Your Best Car) "Essentially, we really do not want clients proceeding with a car if they’re not 100% certain they want it, as it’s a waste of their time and our own."

Clearly they deem their interaction with the public as "time wasting." if you do not keep the car.

When I checked online whether or not this was legal, I discovered that it was not, regardless of any T's & C's that I signed.

Under current UK Law set out in
[The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013]

It is illegal to withhold any amount as consumers are protected under such regulation.
This Act protects the consumer when purchasing goods and services online (distance selling) and covers their right to be entitled to a full refund of any goods and or services purchased in this way, regardless of any terms and conditions that they may have signed.
Moreover, any Terms and Conditions presented by Your Best Car Ltd and signed by their customers, cannot supersede UK legal protections laid down in law.

Please see the below links to the relevant Statutory Instruments that are relevant in this case: legislation.gov.uk - regulation 38
and legislation.gov.uk - regulation 34

I have tried to ask YBC for my money back but they have refused and have not even bothered to respond to any of my most recent emails or calls.

This is totally unacceptable and unprofessional.

I would advise very strongly that you think carefully before engaging with this dealership.

I am proceeding with a legal claim now to try and recover the money that YBC have kept and not returned.

Very good buying experience

I recently bought a Ford S Max from Your Best Car and i can only say it was a really smooth buying experience. The whole buying process was done over the phone and they were knowledgeable about any questions i had about the vehicle. Collecting the vehicle was easy and quick. We then found that there was a issue with the clutch, but this was quickly sorted out by Your Best Car and we are delighted with the car. Would definately buy from them again.

Contacted sales team about a car and over initial calls we outlined terms of a deal that included part exchange of my own car. In the next 24 hours, with each call or message, the terms and conditions of the deal kept creeping and changing with the price of the car going up by £1500 and us being asked to collect the car rather than it being delivered. We clearly could not make the purchase on this basis and the whole thing felt a little unprofessional and manipulated.
