Difficult Situation but Lack of Communication

I and other flatmates approached Phoenix Legal through another company in order to claim compensation for our deposit not being protected. At the beginning of the process we were clear about our situation, that based off our understanding we were subletting a flat without our knowledge. The mense tenant had put the head landlord as the "landlord" on our tenancy agreement. We explained to the trainee solicitor that was assigned to our case, that we believe we should pursue compensation against the mense landlord as well as the head landlord as there is confusion about who was the actual landlord. This was October 2021. The head landlord came back to the Phoenix legal in late december 2021 with information/evidence stating that they did not approve the sublet. We continually sent emails and information to the solicitor assigned to our case, and asking for updates as the original plan was to claim through the court if the letters were ignored. However, the solicitor would either not respond to our emails our respond weeks later with little or no information. They stated that the headlord did not want to be held responsible and that it was the mense landlord who we should deal with. Finally in March 2022 during a phone call it was agreed that the claim should be filed against the mense landlord and would be done shortly. However in April 2022 we get a letter from the director of the firm outlining the risk is to great to continue on a no win no fee basis. Almost 6 months later we are dropped with no phone call or proper apology for wasting our time. I understand the firm's position that they risk not receiving payment from the defendant. However, this was the situation since Jan 2022 when the mense landlord ceased responding.Furthermore were not aware of their misgivings as there was often a delay in communication. In January 2022 we were told the next step was filing a claim and 4 months later told it wasn't feasible? More than anything it is frustrating as we were blindsided by the abrupt change of heart. If I was told in March during the phone call that the situation was difficult and that continuing on a no win no fee basis would be difficult, I would be understanding. But instead we are dropped via email by an attached letter from a director that we neither spoke too or had an communication with. I hold no ill will towards the firm as the case would not be beneficial for them to pursue through the courts. However in the client agreement they acknowledge that receiving compensation through court would difficult, my questions is why then continue with the process after the settlement letters are ignored? As much as I understand their reasoning it could have been handled better, as now I am left with no recourse and mostly likely the perpetrators will continue to get away with their predatory practices. This rating is purely based on the experience I had and is in no way an indictment of the character solicitors who worked on our case as I am sure that they did genuinely want to help us. However the situation could have been handled better. Nevertheless, I do appreciated the work that did go into our claim and I hope in the future these decisions are made earlier and with better care and consideration.

Unfortunately for us, we are prohibited from sharing details of individual cases due to client confidentiality, even if you have chosen to share them. Therefore, we are limited in our ability to respond on a public forum as to why we recommended that you did not pursue your claim and/or why we would not be willing to continue on a no win, no fee basis.

However, we can say that in cases where there is a real risk of a client not being successful we, as as law firm governed by the Solicitors Code of Conduct, have a duty to our client and the Courts not to pursue claims that do not have reasonable prospects of being successful. Furthermore, as a business it would remiss of us to deal with cases we know will not be successful and we will not get paid on, over those cases and clients that have prospects of success and we are more likely to be paid on.

We take on board your comments in respect of the perceived lack of communication, however, as already stated above we are prohibited from going into detail on a public formum, save to say you are correct, I as the business owner emailed you to advise that I would not be willing to continue to pursue the matter as you were at risk of losing.

My apologies if you would have preferred to have had a conversation with me about my decision, but we are asked by the Solicitors Regulation Authority to ensure that our advice is given in writing. I do know, however, that at the bottom of the letter I advised that if you had any further queries to get back in touch. If you wanted to have a call to discuss it I was more than willing to do that. However, sadly you have chosen to give my company a poor review instead, which as a business owner of a small firm, can have a negative impact on my business. It is unfortunate that you have complained about a lack of communication but you have chosen not to communicate your feelings to me directly and instead have chosen to put it on trust pilot to impact me business.

My business has struggled for over 2 years to survive during covid and keep all of the Trainee's and apprentices in jobs. Once through Covid sadly some chose to leave, leaving us understaffed which is why it took longer to deal with your claim than usual as we lost 4 out of 11 staff post covid restrictions lifting. Something I know a lot of other businesses are also suffering from. We do ask our clients for the patience and understanding during this time within every email we send out. You must have missed this.

Sacked today

Sacked today
They took over from another firm nearly two years ago telling me they could get the job done.
Just been told its going to take another year to even get to court. Even tho we had a court date set for December this year.
It seams the Defendants have just walked all over me and these have just let them.
It seems like the only people who make and money in these claims are the solicitors.as it seams if you don't so as they tell you they can just pull the plug after all they have already made there money from it what do they care.

And yes I am angry angry that I believed you work for me and not fir the Defendants and you even took 20k from them and just rolled over for them and as for not ccooperating what a joke you are just becauseI wouldn't agree to court dates in March 2023 just so you could make even more money out of it..and what case you have been fundamentally dishonest and so there will be no case thanks to you alisha and your company.i told you about a health condition and you failed to tell the Defendants this.making me fundamentally dishonest too.so the case would of been thrown out anyway and I could of and mite still end up in prison.thanks for that
And all you care about is getting your money.well good luck with that one as because of you and your bad advice I haven't got a penny to my name. Remember I'll never work again because of this accident.
I'm also seeking legal advice on suing you as your supposed to give reasonable time for your termination of contract giving me time to appoint another . you cant just terminate because I couldn't make court dates and you didn't like that lol .you should of just gone back and said my client can not make them dates.just like the Defendants did.but never mind I'll see you in court.
And as for customer service lol well I have not had a phone call from these since last year.not even to find out how I'm coping considering I haven't and can't work because of this accident.but they don't care about that.all there care about is how much they can make.but unfortunately for them I never signed any agreement with them about terms.so I have another solicitor who will be sorting that part out for me.as for my case I have contacted the Defendants myself and awaiting a phone call from who ever is dealing with it.ill hopefully get a phone call Monday.

Please do not take this review down as its an honest review and I won't be bullied.by solicitors who are supposed to work for there client..plus they where paid £20.000 By THE DEFENDANT'S something not quite right there why would the Defendants pay my solicitors £20.000 pounds on a no win no fee claim.

BY THE WAY I SACKED THEM NO MATTER WHAT THEY SAY .

HIGHLY RECOMMENDED Yet again Alisha and her team have gone…

Yet again Alisha and her team have gone above and beyond to provide the best possible customer service in a situation were we required help to resolve an issue with our building insurance company.
No one should have to go through what our insurance company and their builders put us through but thank goodness we got in touch with Phoenix Legal to help represent us.
Not only did they provide us with excellent legal advice and guidance but they were also a huge support and had compleat empathy for our situation. I feel that in these situations it's so important to be able to deal with someone who can listen thoroughly and someone who can understand not only the problem at hand but also the huge amount of stress and pressure you may feel.

Thank you phoenix legal for fighting and winning our corner. I can't tell you how much of a huge relief it is for this to all be over and I definitely would of had a much bigger melt down if it wasn't for you helping us though everything.

We contacted Phoenix in regards to a…

We contacted Phoenix in regards to a dispute regarding our landlord, Phoenix dealt with the whole process from start to finish, getting us the outcome we wanted. We was updated all the way through and this was resolved quickly and we got the outcome we wanted and deserved I couldn’t thank them enough for helping us do this and we wouldn’t of been able to take on the landlord without them.
